New York Attorney General Letitia James is facing a legal challenge to her role in a high-profile criminal probe. The issue centers on social media posts she made before officially taking over the case. A judge in Monticello, New York, is currently weighing the arguments from both sides.

A man accused in a civil lawsuit regarding an alleged gang rape at Cornell University asked Judge James R. Farrell to remove James from the investigation. His legal team argues that James’ online comments show she had already formed an opinion about the facts. They claim she viewed the allegations as true before reviewing the evidence. The man’s lawyer, Andrew Miltenberg, noted that other qualified legal professionals in the state could have handled the review.

The underlying lawsuit was filed by a former Cornell student identified as Jane Doe in September. She alleges that several men raped her at a fraternity party in 2024. Doe stated that some of the men pressured her into using ketamine, which left her too intoxicated to consent. In a post on September 28, James linked to a news article about the lawsuit and wrote that she was holding the woman in her heart and prayers.

State lawyers argued for a quick dismissal of the challenge. They pointed out that Governor Kathy Hochul has broad authority to appoint special prosecutors. The state contended that Hochul selected James because of her experience with sensitive cases that receive national attention. Assistant Attorney General Kaitlin Vigars told the court that actual prejudice must be shown to disqualify James. She argued that no criminal charges have been filed yet, so the accused cannot claim specific harm.

Judge Farrell did not issue an immediate ruling during the more than one hour of arguments. He questioned the state attorneys about the appropriateness of a prosecutor making public statements before taking a case. He asked directly if he should agree that it is not proper for a prosecutor to make such statements. When Vigars did not answer directly, Farrell pressed her again. He gave the man’s lawyers one week to explain why other men named in the lawsuit did not join this specific effort to remove James.

James addressed her social media presence during an October 8 debate against her Republican challenger, Saritha Komatireddy. She stated that her comments demonstrate empathy. She emphasized that politics stops at the door in her office. She said the investigation would be guided only by the facts, evidence, and law. Governor Hochul expressed confidence in James’ ability to draw proper conclusions from the record.

The case was filed in Albany but argued in Monticello, which is about 72 miles northwest of Manhattan. Farrell is based in that county. A second legal challenge to James’ appointment was filed in Ithaca, where Cornell is located. No arguments have been scheduled for that case yet. The current hearing focused on whether the pre-appointment posts created a conflict of interest.
